Regulatory Lawyer

Cornwall Council is a large and ambitious Council, supported by an experienced and welcoming Legal Service that has a crucial role in providing specialist legal advice to all sectors of the Council, as well as some external organisations. 

We are seeking a full-time, permanent specialist Regulatory / Prosecution Lawyer, qualified as a Solicitor, Barrister or FCILEx, to join our Regulatory & Litigation Team.

You will be joining a busy team with a very varied stream of mainly Prosecution work. Acting principally for the Council but also for external clients, a broad knowledge and proven experience of dealing with prosecutions, preferably on behalf of a regulatory body or local authority, is essential. 

Experience of regulatory work, including Licensing, is desirable, as is an understanding of the local government regulatory framework. 

Excellent oral and written communication skills, including Court advocacy, and the ability to work under pressure and to strict timescales to ensure we deliver expert, bespoke advice to our clients, are a must. You must also be proficient at drafting and a pragmatic problem solver.

The work of the team is varied and challenging and includes, but is not limited to, the following:

• Trading Standards, food safety, health and safety and animal welfare prosecutions and advice.
• Building Control, including dealing with applications for orders, prosecutions and appeals.
• Planning enforcement and listed buildings prosecutions. 
• General Licensing advice (including advice at Licensing Act and other Licensing Committees).
• Prosecutions and appeals regarding breaches of abatement notices in respect of statutory nuisances, prosecutions for dog fouling and prosecutions for littering.
• Education Prosecutions under s444(1) and (1A) of the Education Act 1996, education supervision orders and related matters.
